- A successful temporary leave to remove application brought by a father (“F”) to take his two children to Jordan for a holiday. F was able to offer a variety of safeguards including declarations about the children’s habitual residence, undertakings to return the children to the jurisdiction, a bond of £2,500 and monies to fund the mother’s (“M”) legal costs in Jordan. Re-asserts the importance of the guidance given in Re A (prohibited steps order) [2013] EWCA Civ 115 relating to the consideration of risk. Helpful that M accepted that F had no intention to permanently remove the children from the jurisdiction. Judgment, 16/02/2015, free
